Washington had another favorable verdict recently in a wrongful death mesothelioma case. Though the jury ruled in Plaintiff’s favor, the damages awarded
were fairly modest and the comparative fault award was the largest we have seen in this jurisdiction.
Plaintiff: Henry S. Eisler, Jr. (worked as a contractor at Alcoa Wenatchee Facility)
Represented by: Bergman Draper Oslund Udo
Defendant: Alcoa Corporation
Verdict: $425,000.00
Comparative Fault:
Henry Eisler Jr.: 60%
Alcoa: 40%
Loss of Consortium:
Jennifer Bechtel (daughter): $0.00
(Plf withdrew a consortium claim for one other child).
